General Terms and Conditions

Last updated: October 2026

This is a translation for information purposes only. In the event of any discrepancy, the German version shall prevail.

§ 1 Scope

(1) These General Terms and Conditions apply to all orders placed by consumers via the online shop at lola-aperitif.com with Lola Europe GmbH (hereinafter “we” or “us”).

(2) Our offer is directed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB).

(3) Deviating terms of the customer are not recognised unless we expressly agree to their validity in writing.

§ 2 Contracting party and language of contract

(1) The purchase contract is concluded with:

Lola Europe GmbH
Frohnhofweg 15
50858 Cologne
Germany
Email: hello[a]lola-aperitif.com

Further information about our company can be found in our Legal Notice.

(2) The language of the contract is German. Translations of these Terms into other languages are provided for information purposes. In the event of any discrepancy, the German version shall prevail.

§ 3 Age restriction and protection of minors

(1) Our products contain alcohol. Orders may only be placed by persons who are at least 18 years old. By submitting an order, the customer confirms that they are of legal age.

(2) Goods are handed over exclusively to persons of legal age upon presentation of an official photo ID. For this purpose, we use an age check on delivery provided by our shipping partner. Delivery to parcel lockers (Packstation), parcel shops without age verification or an unattended drop-off location is excluded.

(3) If there are reasonable doubts as to the customer’s age, we are entitled to refuse the order or to withdraw from the contract. In this case, any payments already made will be refunded without delay.

§ 4 Conclusion of the contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) The customer can add products to the cart and complete the ordering process via the checkout. Before submitting the order, the customer can review all details and correct any input errors at any time. By clicking the order button, the customer submits a binding offer to purchase the goods in the cart.

(3) Immediately after submitting the order, the customer receives an automatic confirmation of receipt by email. This does not yet constitute acceptance of the offer.

(4) The contract is concluded when we accept the order by sending a separate order confirmation or shipping confirmation by email, or by delivering the goods. If the customer chooses a payment method in which payment is initiated directly during the ordering process, the contract is concluded upon completion of the payment process.

§ 5 Storage of the contract text

We store the contract text. The order details and these Terms are sent to the customer by email. These Terms can also be viewed and printed on this page at any time.

§ 6 Prices and shipping costs

(1) All prices are final prices and include statutory VAT.

(2) Shipping costs may be charged in addition to the product prices. The amount of the shipping costs is set out in our Shipping and Delivery Policy and is clearly shown during the ordering process before the order is submitted.

(3) For deliveries to Switzerland, additional import charges (in particular customs duties, import VAT and alcohol tax) as well as customs clearance fees charged by the carrier may apply. These are not included in the purchase price and are to be borne by the customer.

§ 7 Payment

(1) Payment can be made using any of the payment methods offered during the ordering process. These include in particular credit card (Visa, Mastercard, American Express), Maestro, Shop Pay, Apple Pay, Google Pay, PayPal and Klarna. Depending on the country of delivery, further local payment methods may be available. The payment methods available in each case are shown during the ordering process.

(2) The purchase price is due upon conclusion of the contract. The order is processed and shipped after receipt of payment or after confirmation of payment by the respective payment service provider.

(3) For payments via PayPal or Klarna, payment is processed by the respective payment service provider. Its terms of use and payment terms, which are shown to the customer during the payment process, apply in addition.

§ 8 Delivery

(1) We deliver to Germany, to all member states of the European Union and to Switzerland.

(2) The estimated delivery times and the shipping costs are set out in our Shipping and Delivery Policy and are shown on the product pages and during the ordering process.

(3) If the ordered goods are not available, we will inform the customer without delay. In this case, any payments already made will be refunded without delay.

(4) If the goods cannot be delivered because the recipient was not present, the required age check was not possible or acceptance was refused, and the customer is responsible for this, the customer shall bear the costs of the unsuccessful delivery attempt, insofar as permitted by law. The statutory right of withdrawal remains unaffected.

§ 9 Retention of title

The goods delivered remain our property until full payment has been made.

§ 10 Right of withdrawal

Consumers have a statutory right of withdrawal. Details, in particular regarding the conditions, deadlines and procedure, as well as the model withdrawal form, can be found in our Right of Withdrawal policy.

§ 11 Transport damage

(1) If goods are delivered with obvious transport damage, we ask the customer to report such damage to the courier immediately if possible and to contact us without delay at hello[a]lola-aperitif.com.

(2) Failure to report or contact us has no effect whatsoever on the customer’s statutory claims, in particular their warranty rights. It does, however, help us to assert our own claims against the carrier.

§ 12 Warranty

The statutory rights regarding defects apply.

§ 13 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence, and in accordance with the German Product Liability Act.

(2) In the event of a slightly negligent breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely (cardinal obligation), our liability is limited to the foreseeable damage typical of the contract.

(3) Otherwise, our liability for damage caused by slight negligence is excluded.

(4) The above limitations of liability also apply in favour of our legal representatives and vicarious agents.

§ 14 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have any questions or complaints, you can reach us at any time at hello[a]lola-aperitif.com.

§ 15 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law applies only insofar as the customer is not thereby deprived of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

(2) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
